RENTAL POLICIES
 

  1. Reading and Signing: The Rental Agreement & Waiver must be fully read and signed by the day of the rental.

  2. Online Reservations and Payments: Online reservations will require payment at the time of booking. If a cancellation occurs, a full refund will be provided. Please call with any questions about this policy.

  3. Cancellation Policy: All cancellations must be made 48 hours prior to the rental. In the event of inclement weather, reservations may be canceled at Lax-Ski's discretion. We want to ensure you enjoy yourself on our Ski, so please call if the weather is in question.

  4. Reservation Terms: Online reservations are accepted for hourly, half-day or whole-day rentals.

    • Morning half-day rentals: Depart as early as 8 A.M. and return by 1 P.M.

    • Afternoon half-day rentals: Depart as early as 2 P.M. and return by 6 P.M.

    • Same-day rentals can accommodate different start times.

  5. Pets: No pets are allowed without prior approval. Any damages incurred by pets will be the responsibility of the renter.

  6. Restricted Area: Boats are required to stay in Pool 8. NO EXCEPTIONS. Locking through any lock and dam is not allowed due to:

    • Potential difficulties in reaching you if assistance is needed.

    • Possible delays at locks, which can take hours to get through.

  7. Late Fee: There is a $50 per hour late fee. Please allow yourself plenty of time to return to the dock.

  8. Prohibited Items: No guns or fireworks are permitted.

  9. Arrival Time: Please arrive 20 minutes before your scheduled rental time to fill out paperwork and review safety and operating procedures.

  10. Vessel Inspection: Customers must inspect the vessel prior to departure, including the propeller. Any damage not noted before departure will be charged to the customer.

  11. Navigation Assistance: A map is available online, and we can review it with you prior to departure if you are not familiar with this pool.

  12. Life Jackets: Customers will ensure all life jackets fit properly, and that all children under the age of 13 wear their life jackets while the vessel is underway.

  13. Return Procedure: When returning, call (608) 205-8162 20 minutes before arriving at the docks, and we will assist with docking/loading the ski.

  14. Trash Removal: The customer is responsible for removing all trash from the Ski. Failure to do so may result in a $25 cleaning fee.

  15. Boaters License - All persons must have a boaters license in order to operate the Ski. You can get a temporary permit for rentals HERE

Lax-Ski Jetski Rental Agreement and Liability Waiver

This Jetski Rental Agreement and Liability Waiver (the "Agreement") is made and entered into as of the date signed below, by and between Lax-Ski ("the Company") and the undersigned renter ("Renter").

1. Acknowledgment of Risk:

Renter acknowledges that operating a jetski involves inherent risks, including but not limited to, risks of bodily injury, death, and property damage. Renter understands and voluntarily accepts these risks.


2. Assumption of Responsibility:

Renter agrees to operate the jetski in a safe and responsible manner and to comply with all local, state, and federal laws, rules, and regulations. Renter assumes full responsibility for any injury, loss, or damage, whether to persons or property, arising out of or related to the use or operation of the jetski.


3. Boater's License Requirement:

Renter acknowledges and certifies that they possess a valid boater's license, as required by law, to operate the jetski. Renter agrees to provide proof of such license upon request by the Company. Failure to possess a valid boater's license will result in the immediate termination of the rental agreement without refund.


4. Waiver and Release of Liability:

Renter hereby waives, releases, and discharges the Company, its owners, agents, employees, officers, directors, successors, and assigns (collectively, the "Released Parties") from any and all claims, demands, actions, causes of action, damages, costs, expenses, and liabilities of any kind or nature, whether known or unknown, anticipated or unanticipated, which arise from or relate to Renter's use or operation of the jetski. This waiver and release extend to any and all claims for personal injury, death, property damage, or any other loss or injury.


5. Indemnification:

Renter agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, causes of action, damages, costs, expenses, and liabilities, including reasonable attorneys' fees, arising out of or related to Renter's use or operation of the jetski, including but not limited to any claims brought by third parties.


6. Damage to Equipment:

Renter is solely responsible for any and all damage to the jetski and any other equipment rented from the Company. Renter agrees to pay for all repairs or replacement costs, as determined by the Company in its sole discretion, resulting from any damage occurring during the rental period.


7. Refundable Deposit:

Renter agrees to pay a $500 refundable deposit at the time of rental. This deposit will be refunded to the Renter upon the return of the jetski and equipment in the same condition as when rented, subject to any deductions for damage, loss, or additional charges incurred during the rental period.


8. Insurance:

Renter is responsible for obtaining and maintaining any insurance coverage deemed necessary or advisable by Renter to cover any potential losses, damages, or injuries arising from the use or operation of the jetski.


9. No Warranties:

The Company makes no warranties, express or implied, regarding the condition, performance, or suitability of the jetski or any other equipment provided. Renter accepts the jetski and equipment "as is" and "with all faults."


10. Governing Law:

This Agreement shall be governed by and construed in accordance with the laws of the state of Wisconsin. Any disputes arising out of or related to this Agreement shall be resolved in the courts of La Crosse County, Wisconsin.


11. Entire Agreement:

This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements or understandings, whether written or oral, relating to the subject matter hereof. No amendment or modification of this Agreement shall be effective unless in writing and signed by both parties.


12. Severability:

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
